Collection
and Use of
Information
Visitors to
our website are
asked to provide
certain
information when
they attempt to
pre-qualify for
our Services,

telephone number
and address. In
combination,
your address and
telephone number
are the only
sources to help
us determine the
type of DSL
service and
speed we can
provide to you
because DSL
technology is
distance-sensitive
and
location-dependent.
Users are also
asked to provide
certain
information when
they sign up for
our Services,
such as name,
address,
telephone
number, billing
information
(such as a
credit card
number) and
email address.
The personal
information
collected from a
user during the
registration
process is used
to manage each
user's account
(such as billing
and collections)
to complete the
ordering process
and to provide
our Services.
Net Star may
use this
information to
contact you in a
number of ways.
We may send you
offers through
email, phone or
regular mail for
Net Star
products and
services, or
offers on behalf
of selected
affiliates. You
may exercise
your options to
not receive any
promotional
marketing offers
via email
through the
means provided
in the email or
by calling

In such cases,
customers will
continue to
receive
administrative
emails from Net
Star. Net Star
may also contact
users to request
additional
information and
feedback. In
addition, Net
Star purchases
services from
third parties
and may need to
provide
information to
those third
parties in order
to provide
Services.
Net Star may
also
automatically
collect and
analyze
information
regarding the
use of Net
Star's services
and web site
activities.
Information
collected may
include, but is
not limited to,
web site traffic
volume,
frequency of
visits, type and
time of
transactions,
type of browser
and operating
system. For
example, we
automatically
record your IP
address so we
can establish a
broad
understanding of
site traffic
patterns. This
information is
logged to help
diagnose
technical
problems,
administer the
site, and
improve the
quality and
types of service
delivered. Net
Star may also
collect, track
and analyze
information that
does not
personally
identify a user
in aggregate
form. This
aggregate data
will be used at
Net Star's
discretion and
may be shared
with third
parties, but
with no
personally
identifiable
information
attached.
Net Star may
employ companies
and people to
perform tasks on
its behalf, and
will need to
share personal
information with
these third
parties to do
so. These third
parties do not
receive any
right to use
such personal
information
beyond what is
necessary to
perform these
tasks. Net Star
may release or
exchange
personal
information if
required to do
so, to comply
with applicable
laws, or to
enforce its
rights or
agreements, or
prevent fraud,
or reduce credit

Star Telecommunications, Inc.
constitutes acceptance of Terms and
Conditions and Acceptable Usage
Policy.
Net Star Telecommunications, Inc.
reserves the right to cancel any
subscriber not adhering to Terms and
Conditions and Acceptable Usage
Policy. |

1. PAYMENT
OBLIGATIONS OF A CUSTOMER.
Net Star services are billed 30
days in advance of delivery.
Payment terms are net, no later
than 10 days after delivery of
services begin. Customers must
provide a (30) day notice,
there are no refunds for unused
portions of services. It is your
responsibility to contact Net
Star to cancel your service. Net
Star may suspend or terminate
service at any time. See section
4 for cancellation policies.
Customer must (a) provide Net
Star with accurate and complete
billing information including
legal name, address, telephone
number, and credit card/billing
information, and (b) report to
Net Star all changes to this
information within thirty (30)
days of the change. Customer are
responsible for any changes to
their account.
Charges are billed to Customer’
credit cards or debit cards, as
applicable, each month for the
basic service and any additional
usage or services. Net Star is
not responsible for any charges
or expenses (e.g for overdrawn
accounts, exceeding credit card
limits, etc.) resulting from
charges billed by Net Star.
Delinquent accounts may be
suspended or canceled at Net
Star’s sole discretion; however,
charges will continue to accrue
until the account is canceled.
Net Star may bill an additional
charge to reinstate a suspended
account
or late fees for past due
amounts.
This is
an important notice of a change
in Terms and Conditions.
The
following changes will take
effect October 1, 2007.
Late
payment fee will be as follows:
18% Annual Percentage Rate (1.5%
Monthly) with a minimum $10.00
charge per invoice on all past due
invoices. This rate will accrue
after a 15 day grace period on the
amount due at the time the fee is
applied.
2.
RESELLER ACCOUNTS
If are
delinquent in payments to Net
Star your client's account may
be suspended or canceled. You
will hold Net Star
Telecommunication completely
harmless for any complications,
loss of revenue or any other
liability that may arise.
If you
purchase services through a
reseller who in turns pays Net
Star, the reseller must pay all
amounts owing for your account.
If the reseller fails to pay Net
Star any amounts due—whether or
not you have paid the
reseller—your account will be
subject to suspension or
cancellation until you or the
reseller has paid all amounts
due.Net Star may charge for
taxes and other applicable fees.
3. REFUNDS
AND DISPUTES
All payments to Net Star
Telecommunications Inc. are
nonrefundable. This includes the
one time activation fee and
subsequent charges regardless of
usage. All overcharges or
billing disputes must be
reported within 45 days of the
time the dispute occurred. Early
cancellation of a service which
has been prepaid for any term
may be prorated but will be left
up to the discretion of the
company. ALL PAYMENTS TO COMPANY
ARE NONREFUNDABLE. Any
considerations for hardship
cases can be sent to
billing@nstci.com and will
be forwarded to the proper
parties.
4. CANCELLATION POLICY
Customers must provide a (30)
day notice, there are no
refunds for unused portions of
services. It is your
responsibility to contact Net
Star to cancel your service. Net
Star may suspend or terminate
service at any time.
Account
Cancellation: all requests for
canceling accounts can be made
in writing, fax or by phone.
Cancellation by writing must be
mailed to (Net Star
Telecommunication Inc. attn.:
billing/cancellations, 10640
Haddington, Houston, Texas
77043). If you wish to cancel by
phone, call 281.240.7300 ext.
319. You must have all account
information to cancel. For your
convenience we have provided a
online fax
authorization form, please
complete the form before faxing.
If
you are under contract you are
responsible for the full terms
or early termination fees
associated with that contract.
Our aim is to keep all our
customers happy with our quality
Internet Service please let us
know when you call, If there is
anything we can do to retain
your business.
5. UNAUTHORIZED
ACTIVITY
Any attempt to access or
modify unauthorized computer
system information or to
interfere with normal system
operations, whether on the
equipment of Net Star or of any
computer system or network that
accessed by our services, will
result in suspension of your
access. Unauthorized activities
include guessing or using
passwords other than your own,
accessing information that does
not have public permission, and
accessing any system on which
you are not welcome. Net Star
prosecutes unauthorized usage.
Net Star reserves the right
to change and otherwise modify
it's services, rates, usage
policy or these Terms and
Conditions. These Terms and
Conditions supersede all
previous representations,
understandings or agreements.
Use of Net Star services
constitutes acceptance of these
Terms and Conditions and
agreement to abide by our Common
Sense Acceptable Use Policy.
6. INDEMNIFICATION STATEMENT
Net Star exercises no control
whatsoever over the content of
the information passing through
it. Net Star specifically denies
any responsibility for the
accuracy, quality or content of
information obtained through our
services. Net Star makes no
warranties of any kind, whether
expressed or implied, for our
services. Subscriber agrees to
indemnify and hold harmless Net
Star from any damage claims
resulting from use of our
services. Net Star may only be
used for lawful purposes.
Transmission of any material in
violation of any federal or
state regulation is prohibited.
Any unauthorized attempt to
access and/or modify information
or normal system operations,
whether on the equipment of Net
Star or of any system that is
accessed by way of Net Star
services is prohibited. We only
provide access. You must take
responsibility for your actions
on our system and the systems
you access through us. You must
comply with whatever rules or
acceptable usage policies are
appropriate for the systems you
access. If you are offended by
information you find on those
systems, your responsibility is
to avoid whatever you find
offensive. You must take
responsibility for the
statements you make in e-mail,
chat or discussion forums, web
pages, and news groups. If you
act irresponsibly or your
actions endanger our system, we
may suspend your access at any
time.
7. ACCEPTABLE USE POLICY
Chat Rooms are
for entertainment, networking
and finding new friends. Be
aware that anyone could be in
any room at any time, including
children. Please conduct
yourself with this in mind.
Adult chat areas are available
at other sites, if you are
looking for this type of
interface, please connect to
them over the net. Chat rooms
here have a blocking word list
and also log offenders.
Persistent attempts at violating
this rule will be removed from
access and asked to take their
business elsewhere. This is not
to censor anyone, only to
protect Net Star, and the
difficulty that can be caused by
such behavior.
Mailing Lists
will be limited, as well as the
number of recipients of any
individual mailing. This is a
necessary precaution to prevent
spamming. No one wants a flood
of unsolicited mail and the time
online it consumes to download.
If you experience e-mail
problems that appear to be
related to this limitation and
you have a need to exceed the
limits, please contact Net Star
and make arrangements to get a
mailing out. Commercial accounts
will be given greater leeway on
this limit.
Mailbox Size
will be limited to 5mb. When
this is reached the system will
return the mail to sender.
Please do not keep your e-mail
stored on the server. Beware of
opening mail from unknown
sources, especially attachments.
Malicious files and applications
can be executed on your system
this way.
News Server
has all 30,000 + news groups
available. Net Star is in no way
responsible for unsupervised
access by minors. Please monitor
your children when on the "net".
Flooding, or spamming of any
news groups will result in
immediate revocation of services
and forfeiture of any
outstanding account balances.
Please do not waste our time and
resources, we can track down the
parties responsible no matter
what masking techniques used.
After Five Hours
online you will be disconnected.
There is nothing preventing you
from reconnecting. You will be
disconnected after twenty
minutes of inactivity. Use of
software to create activity to
circumvent this will be detected
and you will still be
disconnected and support
personal notified. These steps
are necessary to prevent abuse
and people from monopolizing the
resources. Everyone is entitled
to have an opportunity to gain
access. If you want dedicated
access contact Net Star and your
account will be upgraded.
This limitation only applies to
Dialup 56K Accounts. ALL DSL
Accounts include unlimited
usage.
Your Account
is for your exclusive and
individual use only. Multiple
concurrent logins of the same
account are not allowed. Beyond
the fact that allowing others to
use your account is prohibited,
consider that you become
responsible for the charges
incurred by someone else you
have allowed to use your
account. For this reason you
should protect your account and
password as you would any other
personal resource such as your
telephone or credit card.
Each
customer will be held
accountable as to how they use
their web sites and access
accounts.. Please pay close
attention to the Acceptable Use
Policy for this site. We will
bill $100 for any spam or bulk
email sent to each user. The
accessed rate will be $100 for
each email sent to each user
that was unsolicited.
8. SPAMMING
SPAM, BULK MAIL, AND NEWS GROUP
POSTINGS
The transmission of unsolicited
or prohibited advertising or
other content through electronic
mail or inappropriate Usenet
postings is forbidden. The use
of AND/OR reference to your
account in unsolicited mass
mailing or postings (commonly
known as "Spam") by any client
of Net Star Telecommunications
shall also be grounds for
permanent removal of your
account without refund..
This policy is stringently
enforced. The practices
described here can permanently
destroy an online reputation
overnight and easily taints any
organization associated with the
guilty party.
What is Spam?
Spam is sending e-mail to people
who do not know you; many times
referred to as unsolicited
e-mail. If you send information
to your friends, people who know
you, or people that have
requested information you are
generally safe. Bulk mailing is
almost always considered as
spam. Posting advertisements to
inappropriate news groups is
also considered as Spam.
SUSPENSION OF SERVICE
We reserve the right to suspend
or terminate any user account
for any reason.
Some Examples of What May Result
in Account Termination:
Violation of the policy on spam
and/or unsolicited mail already
mentioned above. Breaching, or
attempting to breach security on
any system or network without
the written authorization of
those responsible for said
system or network. Forging Web
Pages, E-mail or news articles.
That is, attempting to make
pages, articles or E-mail appear
to come from someone or
somewhere they do not. If a
user's presence on our systems
jeopardizes our primary purpose,
we may suspend or terminate the
user's account.
There WILL BE NO WARNINGS for
breach of this policy.
Net Star Telecommunications
reserves the right to update
and/or modify this policy as Net
Star Telecommunications sees
fit. By having a Net Star
Telecommunications and your
provider or host you are
agreeing to abide by this policy
and you are agreeing to be
responsible for any and all
damages to the Net Star
Telecommunications domain
related in any way to your
violation of this policy. Net
Star Telecommunications applies
no warranty or guaranty to the
function of this site and you
agree to hold Net Star
Telecommunications harmless and
exempt from any claims related
to the serviceability or
function of this site.
Commercial Advertising, E-mail,
Spamming, or the sending of
unsolicited e-mail, directing a
person to your Web Site is
STRICTLY prohibited. Net Stat
Telecommunications will be the
sole arbiter as to what
constitutes a violation of this
provision.
Server abuse: Any attempt to
undermine or cause harm to our
server at Net Star
Telecommunications server is
strictly prohibited.
Failure to follow any term or
condition will be grounds for
immediate web page deactivation
or access account deactivation.
Any complaints should be
directed to

make sure to send us the name of
the web page that the spam
originated from.
